Terms of Service

1. Who we are

The Service is operated by FlyTrap ("FlyTrap", "we", "us", or "our"). FlyTrap is an AI-powered exploratory testing agent that analyzes mobile applications to detect bugs, UX issues, and crashes.

2. Acceptance of these Terms

By creating an account, joining our waitlist, uploading an application file, or otherwise using the Service, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use the Service. The Service is intended for business and professional use, not for consumers.

4. Beta / early access

The Service is currently offered on an early-access and closed-beta basis. It is provided "as is" and may be incomplete, change without notice, or be discontinued at any time. Features, availability, and pricing may change as the Service evolves.

5. Your content and uploads

To use the Service you may upload mobile application files (for example, Android .apk files) and related materials ("Your Content"). You retain all ownership rights in Your Content.

You grant us a worldwide, non-exclusive, royalty-free license to host, store, process, analyze, and create derived testing artifacts (such as logs, reports, and bug snapshots) from Your Content, solely for the purpose of operating and improving the Service for you.

You represent and warrant that:

• You own Your Content or have all necessary rights, licenses, and permissions to upload it and to allow us to process it as described.
• Uploading and analyzing Your Content does not violate any law, contract, or third-party right (including intellectual property, privacy, or confidentiality rights).
• You will not upload malware, or files you are not authorized to test.

6. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose.
• Attempt to reverse engineer, decompile, or gain unauthorized access to the Service or its underlying systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use the Service to test or analyze applications without proper authorization from their owner.
• Resell, sublicense, or otherwise commercially exploit the Service without our prior written consent.

7. Intellectual property

The Service, including its software, models, design, and content (excluding Your Content), is owned by FlyTrap and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable right to use the Service in accordance with these Terms. No other rights are granted.

8. Third-party services

The Service may integrate with third-party tools and platforms (for example, issue trackers such as Jira, Linear, or GitHub, and analytics providers). Your use of those services is governed by their own terms and privacy policies, and we are not responsible for them.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that it will detect every bug, crash, or issue in any application. You remain responsible for the quality and security of your own applications.

10. Limitation of liability

To the fullest extent permitted by law, FlyTrap and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of the Service. Our total aggregate liability for any claim relating to the Service will not exceed the greater of the amounts you paid us in the twelve months before the claim, or USD 100.

11. Indemnification

You agree to indemnify and hold harmless FlyTrap from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from Your Content, your use of the Service, or your breach of these Terms.

12. Termination

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we discontinue the Service. You may stop using the Service at any time. Provisions that by their nature should survive termination (including ownership, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law

These Terms are governed by the laws of the United States, without regard to its conflict-of-laws rules. The courts located in that jurisdiction will have exclusive jurisdiction over any dispute arising from these Terms, unless mandatory local law provides otherwise.
